The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.01/2026, registered at Police Station Parpodi, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.02.05 16:55:18 +0530 2 District-Bemetara (C.G.) for alleged commission of offence punishable under Sections 296, 351(3), 115(2), 117(2), 333, 191(2), 191(3) of Bhartiya Nyay Sanhita, 2023. 2. Case of the prosecution, in brief, is that the complainant Hemlata Verma lodged report at Police Station, Parpodi, alleging therein that on 03.01.2026 at about 1.00 noon, the accused Gange Verma and Punit Verma came near the house of complainant and abused to her husband Rajesh Verma with filthy language. Thereafter the accused Gange Verma, Punit Verma, Mukesh Verma, Madan Verma & Bhuwan Verma entered into the house of complainant, abused her husband and assaulted with her husband and looking to the said scuffle, the complainant, her mother-in-law & father-in- law came for rescue of complainant's husband, but the accused persons have also assaulted with the complainant, her mother-in- law & father-in-law with the help of club, due to which, they have received injuries. On the basis of said report, the FIR No. 01/2026 has been registered against the accused persons including present applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and he is falsely implicated in the case. He would submit that the applicant has not assaulted the complainant or her family members. He would submit that in fact, the husband of complainant namely Rajesh Verma has assaulted the father of present applicant, due to which, the applicant's father has received grievous injuries. He would submit that the applicant is 3 ready to abide by all the directions and conditions which may be imposed by this Court while granting bail, the applicant is permanent resident of above mentioned address shown in the cause title and there is no likelihood of his absconding or tampering with prosecution witnesses, therefore he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. She would submit that the applicant along with other co-accused persons, trespassed into the complainant’s house and assaulted the complainant’s husband, her mother-in-law and father-in-law while carrying bamboo sticks in their hands, as a result of the assault, the complainant’s husband sustained grievous injuries on his head, hand and left leg, and the mother-in-law sustained grievous injuries on her hand, further the fact that applicant is named in the FIR, therefore the applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, further the fact that the applicant along with other co-accused persons, trespassed into the complainant’s house and assaulted the complainant’s husband, her mother-in-law and father-in-law while carrying bamboo sticks in their hands, as a result of the 4 assault, the complainant’s husband sustained grievous injuries on his head, hand and left leg, and the mother-in-law sustained grievous injuries on her hand, further the fact that the applicant is named in the FIR and investigation is still going on, therefore I am not inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the anticipatory bail application of the applicant - Mukesh Kumar Verma, involved in Crime No.01/2026, registered at Police Station Parpodi, District-Bemetara (C.G.) for alleged commission of offence punishable under Sections 296, 351(3), 115(2), 117(2), 333, 191(2), 191(3) of Bhartiya Nyay Sanhita, 2023 is rejected.
