And In Re : Manohar Kumar Singh ….petitioner With CR.M. (A) 3290 of 2026 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Raniganj Police Station Case No. 0352 of 2026 dated 21.08.2026 under Sections 198, 221, 262, 263, 308(6), 351(3), 59 & 61(2) of the Bharatiya Nyaya Sanhita, 2023 and under Section 13(2), 7 & 7A of the Prevention of Corruption Act, 1988, pending before the Court of the learned Chief Judicial Magistrate, Paschim Bardhaman. And In Re : Biswajit Chatterjee & Ors. ….petitioners Mr. Sabyasachi Banerjee, Sr. Adv., Mr. Abhra Jena Mr. Dwarnadeep Khara Ms. Priyanka Jaiswal …for the petitioner Mr. Kallol Mondal, Ld. P.P., Mr. Amarta Ghose Ms. Supriti Sarkhel …for the State Two applications for anticipatory bail are taken up for consideration analogously as they emanate out of the same police case. 2 In C.R.M. (A) 3249 of 2026, the petitioner who seeks anticipatory bail is a personal security officer, i.e. a police personnel attached to a Member of Parliament. A police complaint of extortion was lodged inter alia against the petitioner along with the Member of Parliament. The concerned Member of Parliament moved a criminal revisional application being CRR 3764 of 2026 in which an order dated September 15, 2026 was passed. In such order, the Coordinate Bench recorded a finding as follows: “Although the complaint alleges that a sum of Rs.15 lakhs was demanded from the complainant by the petitioner and an audio clipping has been relied upon in support of such allegation, upon the said audio clipping being played before this Court, it did not appear to substantiate the allegation.” Since a Coordinate Bench doubted the allegation of extortion in the revisional application as against the Member of Parliament and since the police complaint in the revisional application is the same police complaint in which the petitioner seeks anticipatory bail, I deem it appropriate to grant anticipatory bail to the petitioner. Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. The petitioner will report before the Investigating Officer 3 once a week till the conclusion of the investigation. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. On the parity of the same reasoning, I grant anticipatory bail to the petitioners in C.R.M. (A) 3290 of 2026. Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. The petitioners will report before the Investigating Officer once a week till the conclusion of the investigation. The petitioners shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. The application being C.R.M. (A) 3249 of 2026 and C.R.M. (A) 3290 of 2026 for anticipatory bail are, thus, allowed. (Debangsu Basak, J.)
