Three petitioners are before Court seeking anticipatory bail in respect of a case of murder. 2. There are statements under Section 183 of the BNSS which implicates all the petitioners in the assault leading to the death of the victim. Two of the accused persons were arrested and granted bail. 3. Post Mortem report of the victim suggests that death occurred due to rapture of the spleen caused by blunt force. 4. Statements of two persons recorded under Section 183 of the BNSS states that, at least four persons were involved in assaulting the victim leading to his death. 2 5. One statement under Section 183 of the BNSS names all three petitioners before Court as assailants and involved in the incident. 6. One of the assailants was arrested and was granted bail by the jurisdictional Court. 7. Investigations are yet to be completed. 8. Charge-sheet is yet to be filed. 9. Considering the gravity of the offence and involvement of the petitioners in the incident, I am not minded to grant anticipatory bail to the petitioner. 10. Prayer for anticipatory bail of the petitioners is rejected. 11. CRM(A) 3178 of 2026 is dismissed. (Debangsu Basak, J.)
