Sahu, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 17.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with C.T. Case No.481 of 2024 pending in the file of learned S.D.J.M., Phulbani, Kandhamal arising out of Phulbani Sadar P.S. Case No.115 of 2024 on the grounds stated. 3. Perused the FIR as at Annexure-1. The other accused persons had earlier approached this Court vide ABLAPL Nos.12897 and 12909 of 2025 and the similarly the petitioner in ABLAPL No.11265 of 2025 disposed of on 24th September, 2025 denying him pre-arrest bail with a direction to surrender before the learned court below for being released subject to verification of criminal antecedent. This Court, in view of the above, is not inclined to reconsider the bail plea of the petitioner, however, is of the view that he should once again be directed to surrender before the learned court below seeking regular bail. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the learned S.D.J.M., Phulbani, Kandhamal within a fortnight from today and moves an application for regular bail, it is directed that the same shall be considered in connection with C.T. Case No.481 of 2024 corresponding to Phulbani Sadar P.S. Case No.115 of 2024 during the first hour and in the event of rejection, he shall approach the learned Sessions Court for orders on the same day during second hour itself considering his plea of parity. 6.
