Baruah, learned Additional Public Prosecutor appearing for the State of Assam and Mr. S. Biswas, learned counsel for the respondent No.2/informant. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner, Arman Hazarika has prayed for releasing him on bail after he was arrested in connection with Tezpur P.S. Case No.57/2026 registered under Sections 64(1)/115(2)/351(2) of the BNS, 2023 read with Section 4 of the POCSO Act, 2012. 3. As per the FIR, which was lodged on 28.01.2026, the petitioner who is aged about 19 years deceitfully took away the minor daughter of the informant, aged about 15 years to a rented house at Tumuki in Sonitpur district. And thereafter the accused started to torture her by demanding money and also assaulted her physically and established physical relationship with her. 4. The learned counsel for the petitioner submits that the petitioner is a young boy of 19 years, who was in a love relationship with the victim and they have been living in a rented accommodation of their own accord. And that the present one is a case of adolescent love. 5. The learned counsel representing the informant submits that as per instructions received, the victim has no objection to the release of the petitioner on bail. Page No.# 3/3 6. On the other hand, the learned Addl. P.P submits that the victim is aged only 15 years and the statement of the victim before the Police as well as before the Magistrate implicates the petitioner. 7. Having regard to the facts and circumstances of the present case as well as the period of detention of the petitioner of about 86 days and also the fact that the investigation of the case is almost completed, the prayer for bail is allowed. Accused Arman Hazarika is directed to be released on bail of ₹50,000/- (Rupees fifty thousand) only with two sureties of like amount to the satisfaction of the learned Special Judge, POCSO, Sonitpur. 8. It is further provided that the petitioner shall regularly appear before the trial if one commences and shall not try to influence the witnesses in any manner. 9.
