JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.1468/2023, pending before the I Additional Civil Judge (Sr. Dn.) and CJM, Kolar, for the offences under Sections 341, 427, 504 and 506 of the IPC. 2. Learned counsel for the petitioner and respondent No.2 in unison would submit that during the pendency of the subject petition, the parties to the lis have compromised the dispute between them on the advice of the elders and well wishers. Affidavits of both the parties along with an application under Section 320(2) r/w. 482 of the Cr.P.C. is also filed before this Court to that effect. - 3 - HC-KAR NC: 2026:KHC:1780 CRL.P No. 1956 of 2024 3. The affidavit of respondent No.2 - complainant reads as follows: “2. I state that, I have lodged the complaint before the 1st respondent and same has been registered in crime No.435/2023 for the offence p/u/s. 341, 427, 504, 506 of IPC, Kolar Rural Police Station) same is pending in CC No.1468/2023 on the file of Prl. Senior Civil Judge and CJM at Kolar, same is Pending for adjudication. 3. I state that, During the pendency of the case before the trial court, on the advice of elders and well wishers, myself and the petitioner have compromised the matter with amicably and there is no dispute between the myself and the petitioner herein. 4. I state that, the petitioner is my neighbor and residing in same village, as per the advice of the elders and well wishers myself and petitioner have no grievances against each other.” In the light of the fact that the parties reside in the same village and have arrived at settlement, I deem it appropriate to accept the application and the affidavits and obliterate the proceedings against the petitioner, as the allegations are not against the State. 4.
