Dash, Advocate Oral Order 02 / Dated : 27.02.2026 Heard learned counsel for the parties. The petitioner named above has been made accused in connection with Musabani P.S. Case No. 51 of 2025 for the offence registered under Sections 69 of the Bhartiya Nyaya Sanhita, 2023, pending in the court of A.C.J.M., Ghatshila. It is submitted by learned counsel for the petitioner that the victim is 35 years old and there is delay of four years in lodging the F.I.R. The relationship was absolutely consensual and the case has been lodged only to wreak vengeance. Learned counsel for the State, assisted by learned counsel for the informant, seek an adjournment to file counter affidavit. The prayer for adjournment is rejected, as the same has been made to delay the disposal of instant bail application. Now it is submitted by learned counsel for the informant that Section 69 of B.N.S., 2023 is made out against the petitioner. Having considered the submission advanced on behalf of both sides, it appears that there is delay of four years in lodging the FIR and the nature of relationship appears to be consensual. Under the circumstance, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
