Crl.O.P.No.17091 of 2026 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 06.07.2026 CORAM THE HONOURABLE Mr. JUSTICE C.KUMARAPPAN Crl.O.P.No.17091 of 2026 Selvakumar @Selva ... Petitioner(s) Vs. The State rep. by The Inspector of Police, R-2 Kodambakkam Police Station, Chennai. ... Respondent(s) Crime No.225 of 2022 PRAYER : Criminal Original Petition filed under Section 483 of BNSS, 2023, to enlarge the petitioner on bail in SC No.115 of 2023 on the file of the X Additional District and Sessions Court, Chennai. For Petitioner(s) : Mr.P.Sridhar For Respondent(s) : Mr.S.Yogaraj Sekar, Government Advocate (Crl.Side) ORDER The petitioner, who had earlier jumped bail, was issued a non-bailable warrant on 17.07.2025, pursuant to which he was arrested and remanded to judicial custody on 19.09.2025. 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.17091 of 2026 2. The learned counsel appearing for the petitioner would submit that a non-bailable warrant had been issued against the petitioner on 17.07.2025 and that he was subsequently secured and remanded to judicial custody on 19.09.2025. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail. 3. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail, reiterated the prosecution case and, on instructions, submitted that the petitioner had absconded for nearly two months and was secured only on 19.09.2025. He further submitted that the petitioner has twenty-two previous cases. He would contend that, if the petitioner is enlarged on bail, there is every likelihood of his absconding again, thereby delaying the trial. 4. Considering the above facts and circumstances, particularly the past conduct of the petitioner, the fact that he had absconded for nearly two months after jumping bail, the fact that he has twenty-two previous cases, and the apprehension expressed by the learned Government Advocate (Crl. Side) that the petitioner is likely to abscond again if enlarged on bail, this Court is of the view that it would not be appropriate to grant bail to the petitioner at this stage. 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.17091 of 2026 5.
