In Re : Biswanath Santra & Anr. ...… petitioners Mr. Suman Chakraborty …for the petitioners Mr. Rajendra Banerjee, Ld. APP., Ms. Koel Mukherjee Ms. Chandra Gupta Kamal
…for the State
Petitioner seeks anticipatory bail. State is represented. Victim is present in Court. She is identified by the learned advocate for the petitioners. On the request of the Court, a lady advocate interacted with the victim. Victim stated to the lady advocate that the victim is presently residing in her matrimonial home. Police case is with regard to the alleged torture meted out to the victim at her matrimonial home. Since the victim herself is present in Court and stated that she returned to her matrimonial home voluntarily, I deem it appropriate to grant anticipatory bail to the petitioners. Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of
2 Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.,
2023. The petitioner no.1 will report before the Investigating Officer once a month till the conclusion of the investigation and the petitioner no. 2 will cooperate with the investigation till the conclusion of the investigation. The petitioners shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including cancelling the anticipatory bail granted without further reference to this Court. This application for anticipatory bail is, thus, allowed.
