The petitioner claims to have filed an application under Section 28A of the Land Acquisition Act, 1894 on February 21, 2011 before the Collector, District Howrah. The petitioner claims that he stand on the same footing as that of the petitioner in LA Misc. Case No. 199 of 2006 in whose favour an enhancement of the compensation amount was passed by a judgment dated November 24, 2010 in LA Misc. Case No. 199 of 2006. The grievance of the petitioner is that, till date, the said application has not yet been disposed of. Mr. Chatterjee, learned Advocate, submits that it appears from the materials on record that the application was accompanied by a photocopy of the said judgment and the certified copy of the same was not furnished. Be that as it may, this Court is of the considered view, that the interest of justice would be sub-served if the application under Section 28A of the Land Acquisition Act, 1894 is decided within a specified timeframe. Without entering into the merits of the case made in the application under Section 28A of the Land Acquisition Act, 1894, WPA 27805 of 2025, stands disposed of by directing the Land Acquisition Collector (General), Howrah,
being the respondent no.4, to dispose of the application under Section 28A of the Land Acquisition Act, 1894 as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order along with a copy of the application dated 21st February,
2011. The writ petition is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
