THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ

30.03.2019 by filing the above petition seeking for the aforesaid reliefs.
3. Today, on enquiry as to whether any action has been taken on the representation, counsel for respondent Nos.2 and 3 submits that he has no particular instructions on the same.
4. Counsel for the petitioner would, however, submit that no action has been taken. An application having been filed for transfer of Khata and subsequently, a representation having been submitted on 29.12.2018 has still not been considered and no order has been passed by respondent Nos.2 and 3. The matter relating to Khata under the Karnataka Sakaala Services Act, 2011 (for short,
"Sakaala Act"), necessary orders are required to be passed within 30 days of the application being filed either by accepting or rejecting the said application. In the present matter for seven years, respondent Nos.2 and 3 have sat on the said application and no action has been taken.

5. Though this Court could have issued directions to take action against respondent Nos.2 and 3, at the request of counsel for respondent Nos.2 and 3, I refrain from doing so. But respondent Nos.2 and 3 are put to notice that henceforth any application which is filed for transfer of Khata is required to be considered and acted upon within the time frame prescribed under the Sakaala Act. In the above background, I pass the following:
ORDER i) Writ petition is allowed. ii) A mandamus is issued directing respondent Nos.2 and 3 to consider the representation of the petitioner dated 29.12.2018 at Annexure-J and pass necessary orders within 30 days from the date of receipt of a copy of this order in accordance with law.
