The petitioners are apprehending their arrest in connection with Hiranpur PS Case No.73 of 2025, for offence registered under sections 126(2), 115(2), 74, 76, 352, 351(2), 3(5) of BNS, 2023 and section 3 and 4 of Prevention of Witch (Dain) Practices Act, pending in court of learned Additional Chief Judicial Magistrate, Pakur. 3. Learned counsel for petitioners submits that the alleged occurrence is said to be dated 23.6.2025 wherein the FIR has been lodged on 11.7.2025 and there is dispute with regard to the property and the petitioners and the informant are neighbour. He also submits that the petitioners have approached district administration with regard to the said dispute by way of annexure-2 series. He also submits that co-accused has been granted Anticipatory Bail by this Court in A.B.A. No.528 of 2026. -2- 4. Learned State counsel opposes prayer and submits that the allegations are there of man-handling the informant. 5. Annexure-2 series are the documents which suggest that the petitioners have approached district administration by way of filing petition relating to said dispute and the alleged occurrence is said to be dated 23.6.2025 wherein the FIR has been lodged on 11.7.2025. Co-accused has been granted Anticipatory Bail in aforesaid A.B.A., I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within four weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Pakur, in connection with Hiranpur PS Case No.73 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
