Kausik (Rejected) CRM (M) 2451 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dantan Police Station Case No. 107 of 2025 dated 04.05.2025 under Sections 64((2)(m), 65, 329(4), 294, 308(2), 79 and 61(2) of the BNS, 2023 read with Sections 66E, 67, 67A and 67B of the Information Technology Act, 2000 and Sections 6, 12, and 15 of the POCSO Act, 2012. Learned advocate appearing for the State submits that on 17.09.2026 charges have been framed. However, there were earlier direction to renew the prayer for bail after the evidence of the victim cited by the prosecution is over. Records reflect petitioner was arrested on 05.05.2025. More than 1 year 5 months have passed. State/Prosecution would take steps so that at the earliest the victim is examined. In view of the earlier directions passed in CRM (M) 1918 of 2025 and CRM (M) 754 of 2026 I am not inclined to release the petitioner on bail at this stage. 2 Accordingly, CRM (M) 2451 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
