And In the matter of : Akash Roy @ Octobar Roy
……Petitioner. Mr. Kallol Guha Thakurata
Mr. Md. Wasim Rahaman
Mr. Dipankar Dutta
……for the Petitioner. Mr. Kaushik Dey
Mr. Snehashis Banerjee
Ms. Debjani Halder
….for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 03.05.2025 and since then he is in custody. Charge sheet has been submitted. 3 of the witnesses have been examined already out of 11 witnesses including the vulnerable witnesses. Petitioner as such prays for bail on any stringent condition. State opposes the prayer for bail, refers to the statement of the victim under Section 183 of the BNSS as well as the Medico Legal Examination Report. 2
I have taken into account the submissions of the State as well as the statement before the Judicial Magistrate. Having considered the overall circumstances of the case, I am of the opinion that considering the period of incarceration, petitioner may be released on bail on stringent conditions. Accordingly, prayer for bail of the petitioner is allowed. As such, petitioner, namely Akash Roy @ Octobar Roy be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court (POCSO Act), Krishnanagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court. Additionally, petitioner shall not enter the jurisdiction of Nakashipara Police Station and will report once in a fortnight to the jurisdictional Police Station where he would reside and submit an acknowledgment of the attendance before the learned Special Court on each and every date. Such condition would continue till the same is modified by the learned Special Court when it deems fit and proper.
With the aforesaid observations CRM (M) 1910 of 2026 is allowed. 3
