Mr. Birendra Singh Adhikari, learned counsel for the petitioner. 2. Mr. R.C. Joshi, learned Brief Holder for the State of Uttarakhand. 3. Petitioner is serving as Assistant Teacher in a Government Primary School in District Udham Singh Nagar. He was placed under suspension vide order dated 20.01.2026 passed by District Education Officer concerned. Thus, feeling aggrieved, petitioner has approached this Court, seeking the following reliefs: - (i) A writ order or direction in the nature of Certiorari quashing the impugned suspension order dated 20.01.2026 (Annexure-I) and the consequential order dated 21.1.2026 (Annexure-4) (ii) A writ or direction in the nature of Mandamus directing the respondents to also expedite the enquiry contemplated against the petitioner by considering this close retirement date. 4. After arguing for a while, learned counsel for the petitioner submits that petitioner has made representation against his suspension to the District Education Officer on 04.02.2026, therefore, the concerned Authority be directed to examine the issue raised by petitioner in his representation. 5. Learned State Counsel submits that petitioner has been put under suspension in contemplation of disciplinary enquiry 2026:UHC:1292 and charge-sheet is likely to be issued in near future. He, however, submits that he has no objection, if the writ petition is disposed of in terms of prayer made by learned counsel for the petitioner. 6. Accordingly, the writ petition is disposed of with a direction to District Education Officer (Elementary), Udham Singh Nagar to consider petitioner’s representation and pass appropriate order, as per law, within three weeks from the date of presentation of certified copy of this order.
