30.09.2026 Sl. No.17(DL) Ct. No.14 srm IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE
W.P.A. No. 20124 of 2025 Anowara Khatun & Ors. Versus The State of West Bengal & Ors. Md. Kutubuddin …for the Petitioners. Mr. Brijendra Pratap Singh,
Mr. Asit Kumar De …for the State. 1. By the present writ petition, the petitioners seek for release of the outstanding honorarium of Rs.14,80,995/-. 2. The petitioners contend that the petitioner No.1 is the Teacher-in-Charge, petitioner No.2 is the Assistant Teacher and petitioner No.3 is a non-teaching staff of Kholapota Jamia Islamia Madhyamik Shiksha Kendra. The appointment of the petitioners was provisionally approved with effect from 1st February, 2011 for getting financial assistance in the shape of honorarium from the Government of West Bengal on 4th December, 2019. Since the honorarium was not paid, the petitioners prayed for release of the arrear honorarium pertaining to the period from 1st February, 2011 to 31st November, 2019 amounting to Rs.10,45,608/-, Rs.9,70,854/- and Rs.5,67,570/- respectively. Though the aforesaid amount was allotted, however, the same was not disbursed to the petitioners. By letter dated 7th July, 2020, the
2 Director of Madrasah Education, West Bengal informed that the date of approval of the organising staff of the Madhyamik Shiksha Kendra should be rectified as on 16th May, 2016. Consequently, arrears to the tune of Rs.4,40,913/-, Rs.4,15,027/- and Rs.2,41,815/- was released in favour of the petitioners considering the period of arrear from 16th May, 2016 to 31st November, 2019. However, the arrears ought to have been calculated taking the date of approval as 1st February, 2011 and not 16th May,
2016. Being aggrieved by such action of the respondent authorities, the writ petition has been preferred by the petitioners. 3. Md. Kutubuddin, learned Advocate for the petitioners submits that already the date of approval of the petitioners has been changed from 16th May, 2016 to 1st February,
2011. He seeks direction upon respondent authorities taking into consideration the rectified date of approval and disburse the arrear claim of the petitioners within a stipulated period. 4. Mr. Brijendra Pratap Singh, learned Advocate for the State informs the Court that such arrear amount will be released within a short period. 5.
In view of such submission, the respondent No.7, the District Officer, Minority Affairs, South 24-Parganas is directed to take steps for disbursement of the arrear to the petitioners, upon proper scrutiny and verification, within a period of eight weeks from the date of communication of this order. 3
6. Learned advocate for the petitioner is directed to communicate this order to respondent No.7, the District Officer, Minority Affairs, South 24-Parganas, for necessary compliance. 7. With the above direction, the writ petition being WPA 20124 of 2025 stands disposed of. 8. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 9. Interim order, if any, stands vacated. 10. All connected applications, if any, stand disposed of. 11. There shall be no order as to costs. 12. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
