ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner’s online application dated 16.05.2026 and representation dated 13.06.2026.

The case of the petitioner is that she submitted an online application dated 16.05.2026 requesting the second respondent to survey and fix the boundaries of the subject property comprised in Survey No. 285/6B, measuring an extent of 5 Ares, situated at Pillari Agraharam Village, Denkanikottai Taluk, Krishnagiri District. The petitioner further sought police aid from the third respondent to secure the property and erect a fence around it. Since the said __________ Page3 of 7 https://www.mhc.tn.gov.in/judis
WP No. 25302 of 2026 application has not been considered till date, the petitioner has constrained to file the present Writ Petition.

Mrs. Inthu Karunakaran, learned Government Advocate appearing for the second respondent, submitted that the petitioner’s request for a survey and the fixation of boundary stones would be considered in accordance with law. However, she contended that the prayer seeking a direction for fencing the property cannot be entertained in these proceedings.
4. Considering the facts and circumstances of the case and the
submissions made on either side, this Court, without going into the merits of the case, directs the second respondent to consider the petitioner's online application dated 16.05.2026 and subsequent representation dated 13.06.2026. The second respondent is directed to conduct a survey of the subject property in Survey No. 285/6B, situated at Pillari Agraharam Village, Denkanikottai Taluk, Krishnagiri District, and fix the boundary stones within a period of six (6) weeks from the date of receipt of a copy of this order, after giving due notice to the petitioner as well as any adjacent land owners/interested parties. __________ Page4 of 7 https://www.mhc.tn.gov.in/judis

5. Acceptance is given to the contention of the learned Government Advocate that the relief sought by the petitioner regarding fencing of the property cannot be granted by this Court. Liberty is, however, granted to the petitioner to approach the competent Civil Court to seek appropriate relief regarding fencing or any boundary dispute in the manner known to law

It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the Police, and the 3rd respondent / jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court.
