For Petitioner(s): Mr. P.Muthamizhselvakumar For Respondent(s): MR.S.YOGARAJA SEKAR, GOVT.ADVOCATE (CRL.SIDE ) ORDER The petitioner, who was arrested and remanded to judicial custody on 20.05.2026 for the alleged offences under Sections 8(c) read with 20(b)(ii) (B) of NDPS Act,1985 in Crime No.221 of 2026 on the file of the respondent police, seeks bail. https://www.mhc.tn.gov.in/judis CRL OP No. 17435 of 2026 __________ Page2 of 4 2.The case of the prosecution is that the petitioner/accused, along with the co-accused, was found in possession of 30 Mitrazepam tablets intended for sale, and the same were seized by the respondent police. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case. It was further submitted that the petitioner is in no way connected with the alleged offence and that the quantity of the contraband recovered falls within the intermediate quantity. On the above grounds, the learned counsel prayed that the petitioner be enlarged on bail. 4. The learned Government Advocate (Crl. Side) strongly opposed the bail application and submitted that the petitioner has as many as five previous criminal cases, out of which two are of a similar nature, two are under the IPC, and one is under the COTPA Act. It was further submitted that the petitioner had also been detained under Act 14. Hence, the learned Government Advocate prayed for dismissal of the bail application. 5. Considering the submissions made by the learned Government Advocate (Crl. Side), it is seen that the petitioner has five previous case, including two cases of a similar nature. It is also brought to the notice of this Court that the petitioner was previously detained under Act 14. 7.
