In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Durgapur Police Station case no. 18 of 2026 dated 12.01.2026 under Sections 65(2)/351(3) of the Bharatiya Nyaya Sanhita, 2023 read with 4/6 of the POCSO Act, 2012.
And In the matter of : Narayan Majumder @ Roni
……Petitioner. Mr. Rohan Bhavishi
.....for the Petitioner. Mr. Amarta Ghosh Mr. Shoumilya Mazumder
……for the State. Ms. Trina Mitra
......for the Victim (High Court Legal Aid Services Authority)
Learned advocate appearing for the petitioner submits that petitioner is innocent and is in custody for more than seven months, two of the vulnerable witnesses have already been examined. Learned advocate appearing for the de-facto complainant has opposed the prayer for bail. Learned advocate appearing for the State has produced the medico legal examination report as well as the Case Diary. On an assessment of the materials, I am of the opinion that as the accused is aged 29 and the victim is of 11 years, this is not a fit case for granting bail. Accordingly, CRM (M) 2545 of 2026 is dismissed.
