05.10.2026 Serial no. 13 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1897 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with English Bazar PS Case No. 374 of 2026 dated 16.03.2026 u/s 21(c)/29 of the NDPS Act. -And- In the matter of : Kartick Ghosh … … Petitioner(s) Mr. Apan Saha Mr. MusharrafAlam Sk Sk. Sarfaraj Nawaj Mr. T. Ahmed … for the Petitioner(s) Mr. Goutam Dey Mr. Ranjit Singh … for the State-respondent(s) Learned advocate for the petitioner submits that although the subject-matter of the case relates to alleged recovery of 763 gm of brown sugar but there has been no recovery from the present petitioner and the recovery was effected from the other accused persons. Learned advocate for the State opposes the prayer for bail and submits that there are criminal antecedents of the present petitioner. I find that there are four criminal cases, out of which, three cases are under the provisions of the IPC and 2 last of the case being English Bazar PS case no. 722 of 2024 which is under Section 21(c)/29 of the NDPS Act. Learned advocate for the petitioner again submits that in the said case he is already on bail. However, so far as the present case is concerned, the report of the police authorities reflects that there are no CDR and/or money trail with the principal accused person. So far as the materials which are surfaced are only the statement of the co-accused. Having considered the same, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Kartick Ghosh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1897 of 2026 is allowed. 3 Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
