1. The petitioner’s father was a teacher who died-in- harness on May 14, 1975. The mother of the petitioner was receiving family pension. She expired on April 23, 2014. The petitioner being the widow daughter of the deceased teacher seeks family pension. The petitioner applied for family pension, but the same has not been responded till date. 2. During pendency of the writ petition, in compliance with the request made by the school authority, the petitioner submitted certain documents for processing her file for grant of family pension in November 2025. 3. Prayer has been made to direct the respondents to issue family pension PPO in her favour and to disburse the amount mentioned therein. 4. Reliance has been placed on the judgment delivered by the Special Bench of this Court on June 20, 2023 in MAT No.1518 of 2019 with IA No. CAN 2 of 2019 (Old CAN 10437 of 2019) in the matter of The State of West Bengal & Ors. –vs- Sabita Roy with MAT No.608 of 2021 with IA No.
CAN 2 of 2021 in the case of The Director of Pension, Provident Fund and Group Insurance and Others –vs- Kabita Sinha & Ors. etc. 5. None represents the respondents despite service. Affidavit of service and notice of upgradation are on record. 6. As the entitlement of receiving family pension by the widow daughter of a teacher who got superannuated or expired prior to April 1, 1981 has been conclusively decided by the Court in the matter of Sabita Roy (supra). The petitioner has already submitted all documents sought for by the school authority in November 2025. 7. Accordingly, the school authority is directed to make the family pension file of the petitioner ready without any further delay and forward the same to the DI of Schools (SE), Purba Medinipur for onward transmission of the same to the Director of Pension, Provident Fund & Group Insurance, Government of West Bengal for issuance of the family pension payment order in her favour. 8. The school shall forward the file to the DI of Schools positively within a period of six weeks.
The DI of Schools shall forward the file to the DPPG within six weeks thereafter. The DPPG shall take steps for issuance of family pension order in favour of the petitioner within a period of eight weeks thereafter. 9. The writ petition is disposed of. 10.
