GP FOR REVENUE (AP) The Court made the following: 3 VS,J W.P.No.24184 of 2018 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue a writ of mandamus declaring the action of the respondents in not rectifying the records of the 3rd respondent and removing the petitioners land admeasuring 2 Acres 2 Cents of Sy. No. 692/2 of Savisettipalli Village, S.A.K.N Mandal from the list of prohibited properties and pass ….” 2. The case of the petitioner is that the petitioner is the absolute owner and possessor of land admeasuring Ac.2.27 cents in Sy.No.692/2 of Savisettipalli Village, S.A.K.N. Mandal, which has been in the continuous, peaceful and lawful possession of his family for over 100 years. The petitioner intended to sell the property to meet his children's educational expenses and other family necessities. However, the 3rd Respondent refused to register any document on the ground that the land was included in the list of prohibited properties under Section 22-A(1)(b) of the Registration Act, 1908. On coming to know about the same, the petitioner submitted representations to the 2nd and 4th Respondents, who endorsed that the land had been mistakenly included in the prohibited list. The petitioner also approached the Permanent Lok Adalat, Kadapa, where the Government Pleader admitted the error, and thereafter the Permanent Lok Adalat vide Award dated 09.09.2017 directed rectification of the records. Pursuant thereto, the 4th Respondent, by proceedings Ref.No.B/162/2018 dated 08.06.2018, informed the 3rd 4 VS,J W.P.No.24184 of 2018 Respondent that there was no objection to registration of the petitioner's land. Despite these directions and official communications, the 3rd Respondent has continued to refuse registration of documents relating to the petitioner's property. Aggrieved by the said action, the petitioner has filed the present Writ Petition. 3. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. 4. Today, when the matter came up for hearing, the learned Assistant Government Pleader for Revenue furnished a copy of instructions of the 4th respondent vide Ref.no.W.P.No.24184 of 2018, dated 28.06.2026, wherein it is stated that, upon verification of the Encumbrance Certificate available on the official portal of the Registration and Stamps Department, Government of Andhra Pradesh, it was found that the petitioner had executed a registered sale deed in favour of one Sri Devasani Gopinath Reddy, conveying the subject land admeasuring Ac.2.27 cents in Sy.No.692/2 of Savisettipalli Village, Sri Avadutha Kasinayana Mandal under document No.2533 of 2019, dated 03.09.2019. In support of the said contention, a statement of encumbrance has also been filed, which establishes that during the pendency of the present writ petition, the petitioner had already sold the property on 03.11.2019. 5. In view of the above, it is evident that the petitioner has already executed a registered sale deed in respect of the subject property during the 5 VS,J W.P.No.24184 of 2018 pendency of the writ petition. Therefore, the grievance raised in the writ petition no longer survives for adjudication. 6. Accordingly, the writ petition is closed. There shall be no order as to costs.
