Heard Mr. M. A. I. Hussain, learned counsel for the petitioner and Mr. N. Upadhyay, learned Standing Counsel, Irrigation Department. 2. The case of the petitioner is that the petitioner after award of a contract by the Irrigation Department has completed the work of "Construction of 0.60 M dia hume pipe gated inlet at Ch.8580.00 of Branch Canal of C.M. Dutta Bund i/s (Ph-II) under AIBP 2012-13 as well as Re-sectioning, raising, strengthening and widening of canal embankment by earth from Ch.2997.50 M to 3049.50 M of Branch canal (Extension of canal system) of C.M. Dutta Bund Irrigation Scheme (Ph-II) under AIBP, 2012-13. 3. It is contended that, despite submission of bills and issuance of various reminders, the balance payment of the due bills amounting to Rs. 51,527/- and Rs. 86,932/- respectively for the aforesaid two works have not been made. 4. Mr. Upadhyay, learned Standing Counsel, has submitted a communication received from the Executive Engineer, Mangaldai Dalgaon-Sipajhar Division (Irrigation), Mangaldai, dated 18.03.2026, which is kept on record, marking ‘X’. 5. The aforesaid communication dated 18.03.2026 reveals that an amount of
Page No.# 3/3 Rs. 1,38,405/- is due to the petitioner. 6. Mr. Hussain, learned counsel for the petitioner, submits that the matter can be disposed of with a direction to release the amount within a stipulated time, since the amount is admitted by the Irrigation Department. 7.
In view of the aforesaid, the instant case is disposed of with a direction to the Chief Engineer, Minor Irrigation, Assam, Chandmari, Guwahati/the respondent No. 2 to release the aforesaid admitted amount within a period of 2 (two) months from the date of receipt of a certified copy of this order, after due verification of the documents. 8. The petitioner is directed to submit a certified copy of this order to the aforesaid authority at the earliest. 9. In terms of the aforesaid directions, the writ petition stands disposed of.
