GP FOR SERVICES II The Court made the following: 3 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 16292/2026 O R D E R: The present Writ Petition is filed to declare the action of the Respondent Authorities in not finalizing and not sanctioning / releasing the pension and other retirement benefits after retirement of the Petitioner, as illegal and arbitrary. 2. The Petitioner had joined in the Agricultural Market Department on 01.03.1985 and after working in various capacities, had retired from service on attaining the age of superannuation of 62 years at Agricultural Market Committee, Rajamahendravaram, East Godavari District as Selection Grade Secretary on 30.11.2025. It is stated that till date, either pension or retirement benefits have been sanctioned by the Respondent Authorities. Hence, the present Writ Petition is filed. 3. Heard both learned counsel. 4. Learned Assistant Government Pleader for Services-II, on instructions from Respondent No.4, submits that 11 objections were raised during verification of the Service Register of the Petitioner by the District Audit Officer, State Audit, Kakinada. It is submitted that pursuant thereto, the Regional Joint Director, Marketing, Visakhapatnam, was requested to rectify the objections 1, 2, 3 and 9 vide office memo dated 13.05.2026 and also 4 requested the Establishment and Disciplinary Section at Head Office to furnish information regarding the objections 4 to 8 and objections 9 and 10 respectively vide U.O. Note dated 14.05.2026. It is stated that the Establishment Section and the DC Section, Head Office had furnished information on objections 4 to 8 and 9 and 10 and clarification is to be received from RJDM, Visakhapatnam. 5. Considering the submissions and as the pension papers are under consideration, the Writ Petition is disposed of with the following directions: (i) the Respondent Authorities shall finalize the pensionary benefits due to the Petitioner within a period of six (06) weeks from the date of receipt of a copy of this Order. (ii) the Respondent Authorities shall disburse amount to the Petitioner within a further period of six (06) weeks thereafter. (iii) there shall be no order as to costs.
