JUSTICE SAMEER JAIN Order 18/03/2026 1. The instant bail applications have been filed under Section 483 BNSS on behalf of accused-applicants. The accused-applicants were arrested in connection with FIR No. 2/2026 registered at Police Station Pagariya District Jhalawar for the offence(s) under Sections 8/15, 25, 29 of NDPS Act. 2. Learned counsel for the accused-applicants has submitted that the applicants are wrongly implicated in the instant case. It is [2026:RJ-JP:11614] (2 of 2) [CRLMB-1886/2026] submitted that the recovered contraband is 3.86 Kgs, of opium poppy powder which is less than the commercial quantity i.e. 50 Kgs. It is submitted that charge-sheet in the instant matter has been filed. It is submitted that the applicants are having one criminal antecedent registered against themselves, however interconnected matter, wherein also false implication is made. 3. Per contra, learned Public Prosecutor has opposed the instant bail applications. 4. Heard and considered. 5. Considering the overall facts and taking note of the fact that that the applicants are wrongly implicated in the instant case; that the recovered contraband is 3.86 Kgs of opium poppy powder which is less than the commercial quantity i.e. 50 Kgs; that charge-sheet in the instant matter has been filed, but without commenting upon the merits/demerits of the case, this Court is inclined to enlarge the accused-applicants on bail. 6. Accordingly, the bail applications under Section 483 BNSS are allowed and it is ordered that accused-applicants Shripal Singh S/o Balu Singh & Dilip Singh S/o Suresh shall be enlarged on bail provided they furnish a personal bond of Rs.50,000/- each, with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so. 7.
