Heard Mr. Ashish Gangwani, learned counsel for the petitioners as well as Mr. Sourabh Sahu, learned Panel Lawyer, appearing on behalf of the State/respondents No.1 & 2 and Mr. Achyut Tiwari, learned counsel appearing for respondent No.3. 2. It is stated that CRMP No.2813/2024 filed by husband of respondent No.3 has already been dismissed by peremptory order dated 18.10.2024. 3. The present petition has been filed by the petitioner with the following relief(s):- “It is, therefore, prayed that this Hon'ble Court may kindly be pleased to quash the proceedings arising out of the criminal case bearing number 4242/2022 (State v/s Satish Kumar Kurmi @ Umesh & Ors) which is pending on the file of the learned Court of Judicial Magistrate- First Class, Bilaspur, District Bilaspur as on the date and also, all proceedings/processes consequential thereof and incidental thereto. Also, this Hon'ble Court may kindly be pleased to quash the order dated 10.10.2023 vide which the learned Trial Court drew the charges against the Petitioners under Sections 498A read with Section 34 of the Indian Penal Code. In addition, this Hon'ble Court may be pleased to quash the Final Report bearing number 49/2022 dated 3 29.08.2022, presented against the Petitioners by Respondent State i.e. PS Mahila Thana, District Bilaspur in connection to FIR bearing number 18/2022.” 4. Learned counsel for the parties jointly submit that during the pendency of the present petition, the dispute between the petitioners and respondent No.3, which had led to the registration of the FIR and the consequential criminal proceedings, has been amicably resolved by mutual consent. It is further submitted that, in view of the said settlement arrived at between the parties, no surviving grievance now subsists and respondent No.3 does not wish to pursue the matter any further. Accordingly, learned counsel submit that no useful purpose would be served by keeping the present petition pending and the same may be disposed of as having become infructuous. 5. In view of the aforesaid joint submission made by learned counsel for the parties and having regard to the fact that the underlying dispute stands amicably settled, this Court is of the considered opinion that nothing further remains to be adjudicated in the present petition. Consequently, the instant petition is rendered infructuous and is, accordingly, disposed of as such. Any pending applications, if any, also stand disposed of.
