For Petitioner : Mr.M.Sankar For R-1 to R-4 : Mr.K.Saravanan Counsel for State of Tamil Nadu For R-5 & R-6 : Mr.J.Vishnu Government Advocate (criminal side) ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing respondents 2 to 4 to conduct a survey and demarcate the boundaries of the property situated in Survey No.455/15B, measuring an extent of 4.50 Ares, in Kavalaikurichi Village, Alangulam Taluk, Tenkasi District, with the assistance of the sixth respondent, within the time frame fixed by this Court, based on the petitioner's representation dated 16.04.2026. 2. The petitioner is claiming right over the property comprised in Survey No.455/15B, measuring an extent of 4.50. According to the petitioner, originally the said property belonged to the petitioner's grandfather, namely, Muthaiya Nadar, son of Velayutha Nadar and Patta No.929 stands in his name. However, the said Subramanian predeceased his father on 30.10.1991. Thereafter, the said Muthaiya Nadar died on 19.07.2004, leaving behind the legal heirs of his predeceased son, namely his wife Bagavathi and the petitioner. According to the petitioner, Muthaiya Nadar, had only one son, namely, the petitioner's father, Subramanian. 3. In view of the above, the petitioner is directed to produce the legal heir certificate of the deceased Muthaiya Nadar before the official respondents. Thereafter, the official respondents is directed to consider the case of the petitioner after issuing notice to the petitioner and the seventh respondent. It is made clear that no survey shall be conducted before an order is passed on the petitioner's request. If the fourth respondent decides to proceed with the survey, the fourth respondent shall once again issue notice to the petitioner and the seventh respondent and thereafter conduct the survey in accordance with law. If the fourth respondent requires police protection, the same shall be provided by the sixth respondent. If the petitioner intends to install boundary stones and seeks police protection, the installation of the boundary stones as well as the police protection shall be provided at the cost of the petitioner. The official respondents shall adhere to the following Standard Operating Procedures: 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18401 of 2026 • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 4. With the above directions, this Writ Petition is disposed of.
