JUSTICE ANUP JAIRAM BHAMBHANI O R D E R % 02.04.2026 CRL.M.A. 10022/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks modification of order dated 27.03.2026 to the limited extent that the order records in paras 5.2. and 5.3. thereof that the petitioner would not leave the State of Delhi without permission of this court and that he would report to the I.O./SHO at P.S.: Chandni Mahal, Delhi once a week as detailed in that order. 2. Mr. Ankit Tondon, learned counsel for the petitioner submits, that it can been seen from a bare perusal of paras 4 and 6 of the interim bail petition, the petitioner had submitted to the court that his family, This is a digitally signed order. Furthermore, it is pointed-out that in para 7 of the interim bail petition, the petitioner had also informed the court that his wife was to deliver at a certain hospital in Lucknow. 4. In the circumstances, counsel submits, the travel restraint placed vidé paras 5.2. and 5.3. of order dated 27.03.2026 would defeat the purpose of interim bail; and prays that those conditions be modified, to enable the petitioner to avail the interim bail granted. 5. Issue notice. 6. Ms. Richa Dhawan, learned APP appears for the State on advance copy; accepts notice; and in view of what is narrated above, Ms. Dhawan leaves it to the court to pass appropriate orders. 7. The averments in the present application are borne-out from the record. The prayer made is reasonable and fair. 8. Accordingly, the application is allowed. 9. Paras 5.2. and 5.3. of order dated 27.03.2026 are modified and replaced with the following paras:- “5.2. While on interim bail the petitioner shall confine himself to the city of Lucknow except for travelling to and from prison in Delhi and shall ordinarily reside at the address indicated in para 4 of the interim bail petition 5.3. The petitioner shall present himself before the I.O./S.H.O., P.S.: Lambipur, District-Azamgarh, Uttar Pradesh every Wednesday between 11 am and 11:30 am to mark his presence. However, he will not be kept waiting longer than an hour for this purpose;” This is a digitally signed order.
