ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing respondents 1 and 2 to conduct a survey of the petitioner's property comprised in Survey Nos.319/1A2A and 319/1A2C, measuring a total extent of 0.93.00 Hectares, situated at Ramakkoundanpatti Village, Vadipatti Taluk, Madurai District, and to install boundary stones as per the revenue records by obtaining adequate police protection from the third respondent within the period that may be stipulated by this Court. 2. The petitioner is claiming right over the property comprised in Survey Nos.319/1A2A and 319/1A2C measuring a total extent of 0.93.00 Hectares. The petitioner purchased the said property through a registered sale deed dated 23.06.2022, vide Document No.1702 of 2022. Thereafter, separate Patta No.980 was issued in favour of the petitioner. 3. W.P(MD)No.18402 of 2026 online application of the petitioner, the survey had already been conducted. However, the petitioner has expressed that he is not satisfied with the said survey. Therefore, the petitioner is directed to submit a fresh application seeking to survey the property, within a period of four weeks. 4. In view of the above, the first respondent is directed to conduct a survey with the assistance of the second respondent after issuing notice to the petitioner and the rival claimants, if any. If the first respondent requires police protection, the same shall be provided by the third respondent police. If the petitioner is seeking to lay boundary stones, the same shall be laid at the cost of the petitioner. In case if the petitioner is not satisfied with the survey, he is at liberty to approach the appellate authority or the competent Civil Court. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. 3/6 https://www.mhc.tn.gov.in/judis
W.P(MD)No.18402 of 2026 • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties.
The said exercise shall be completed within a period of twelve weeks from the date of receipt of the petitioner's fresh application. 5. With the above directions, this Writ Petition is disposed of.
