CRL OP(MD). No.12854 of 2026 Sections 331(4) and 305(a) of BNS Act, 2023, in Crime No.0244 of 2026, on the file of the respondent police seek anticipatory bail.
2. The allegation against the petitioners is that the petitioner herein is a close relative of A1 in this case, and he joined hands with the other accused involved in stealing 65 sovereigns of gold ornaments, silver articles valued at about Rs.1 lakh, and 1 car from the defacto complainant's house. Hence, the case.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that a part of the property stolen was recovered from A1. Hence, he prayed to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and on instructions, submitted that A1 was arrested and based on the statement of A1 only, stolen car was recovered and the remaining properties yet to be recovered 2/5 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.12854 of 2026 and the the investigation is at preliminary stage. Hence, he opposed to grant anticipatory bail to the petitioners.
5. I have gone through the FIR and also the connected materials. Reading of the FIR reveals that majority of the articles stolen were with the petitioners herein and if the petitioners granted anticipatory bail, there is no possibility to recover the jewels, hence, I am not inclined to grant anticipatory bail to the petitioners.
