BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 24.04.2026 This is a common order for both the matters. 1. Heard Mr. M. I. Hussain, learned counsel for the petitioners. Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor for the State of Assam. 2. These two bail applications are filed under section 483 and 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Abhayapuri P.S. Case No.47/2026 under Sections 189(2)/ 61(2)/ 117(2)/ 109 of the BNS, 2023. 3. The informant Rashida Begum has lodged an FIR before the Police alleging that a person called Jubbar Ali has borrowed a sum of Rs.1500/- from her husband Montaj Al. On 08.02.2026 at about 7 PM Montaj Ali wanted back his money from Jubbar Ali. On the other hand, Jubbar Ali had called Montaj Ali at his house over the phone at about 9.30 PM. When Montaj Ali proceeded to the house of Jubbar Ali, he was assaulted by Jubbar Ali and Jahurul Islam, resulting in fractures to his hand and leg. 4. The petitioner Ambia Khatun is the wife of Jubbar Ali and the petitioner Monowar Hussain is a co-villager. It may be mentioned that in this case the other petitioner Jabed Ali was arrested by Police. 5. I have gone through the Police forwarding report. Jabed Ali has already completed 36 days in judicial custody. Page No.# 3/3
6. This Court is of the opinion that he (Jabed Ali) no longer deserves to be detained in custody. Therefore, the bail application of the petitioner Jabed Ali is allowed. 7.
The petitioner, Jabed Ali, who was arrested in connection with Abhayapuri P.S. Case No.47/2026 under Sections 189(2)/ 61(2)/ 117(2)/ 109 of the BNS, 2023 (in Bail Application No.1068/2026) shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (M), North Salmara, Abhayapuri, Assam. 8. It is also directed that in the event of arrest in connection with Abhayapuri P. S. Case No.47/2026, (in AB No.823/2026) the petitioners, Ambia Khatun and Monowar Hussain shall be allowed to go on bail of Rs.25,000/- each, with sureties of like amount to the satisfaction of the arresting authority. 9. These two petitioners, Ambia Khatun and Monowar Hussain shall co-operate with the Police Investigating Officer as and when called for. 10.
