In the matter of : Samir Sardar
… … Petitioner(s)
Mr. Himanshu De, Sr Adv. Mr. Srinjan Ghosh
… for the Petitioner(s)
Mr. Aditya Tiwari Ms. Namrata Chatterjee
… for the State-respondent(s)
Learned Senior advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused [Sk Sajahan @ Sk Sahajan] who has been granted bail by the Hon’ble Supreme Court in a Special Leave to Appeal (Crl.) No. 11813 of 2026. State opposes the prayer for bail but is unable to refute the locus of the present petitioner with that of Sk Sajahan who has been granted bail by the Hon’ble Supreme Court. Having considered the same, I am inclined to release the petitioner on bail on such terms and conditions as was imposed upon Sk Sajahan, while being released by the learned Special Court.
2 Hence, the prayer for bail of the petitioner [Samir Sardar] is Allowed. Accordingly, CRM (NDPS) 2025 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
