And In Re : Mabud Ali @ Mamud ...… petitioner Md. Wasim Akram Mr. Hamidul Hoque …for the petitioner Mr. L. Vishal Kumar Mr. Sanjib Das …for the State The police filed charge sheet. Obviously, no recovery was made from the possession of the petitioner. Materials in the case diary do not suggest an immediate nexus between the petitioner and the seized commercial quantity of narcotics. No criminal antecedents of the petitioner is brought to the notice of the Court. In such circumstances, the petitioner is able to overcome the restrictions of the NDPS Act., 1985. Consequently, I grant anticipatory bail to the petitioner. Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the 2 conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
