CRR 3647 of 2026
Keshab Mondal & Ors. -vs- The State of West Bengal
Mr. Shataroop Purkayastha Mr. Sarbananda Sanyal Ms. Rajorna Mazumder
…for the petitioners
The petitioners seek expeditious disposal of G.R. Case No. 181 of 2022, pending before the learned Judicial Magistrate, 3rd Court, Katwa, Purba Bardhaman, arising out of Katwa Police Station Case No. 85 of 2022 dated March 8, 2022, under Sections 341/323/326/379/506/34 of the Indian Penal Code, 1860. Learned advocate appearing for the petitioners submits that, on an earlier occasion, he had filed CRR No. 5520 of 2025 seeking expeditious disposal of the proceeding. A Coordinate Bench of this Court, by an order dated December 24, 2025, directed the learned Magistrate in the court below to make every endeavour to dispose of the case expeditiously and to conclude the trial, preferably within a period of six months from the date of hearing. It appears that, by an order dated August 5, 2026, the learned Magistrate in the court below adjourned the matter to September 10, 2026, for further hearing. It is submitted that, out of a total of nine witnesses, only two witnesses have been examined, and that too only in part. Learned advocate appearing for the petitioners submits that, despite the aforesaid order, there has been no effective progress in the trial thereafter.
2 In view of the aforesaid circumstances, this revisional application is disposed of with a specific direction upon the learned Judicial Magistrate, 3rd Court, Katwa, Purba Bardhaman, to conclude the trial within a period of four months from the date of communication of this order, without granting any unnecessary adjournment to the parties. Accordingly, CRR 3647 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
