[2026:RJ-JP:7989-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Civil Contempt Petition No. 378/2022 In D.B. Special Appeal (Writ) No.253/2019 In S.B. Civil Writ Petition No.7101/2013 S.S. Sharma S/o Late Shri B.r. Sharma, Aged About 68 Years, Ex. Manager (HR) RDPL (A Govt. Of India Undertaking), Resident Of 5/103, Vidhyadhar Nagar, Jaipur (Raj.). ----Petitioner Versus 1. Mrs. Nirja Saraf, (M.d. Hindustan Antibiotics Ltd. Pampri, Pune) Acting Managing Director, Rajasthan Drugs And Pharmaceuticals (A Govt. Of India Undertaking) Road No. 12, Vki Area, Jaipur. 2. Mrs Aparna, Secretary, Ministry Of Chemicals And Fertilzers, Govt. Of India, Shastri Bhawan-A Wing New Delhi-110001). 3. Shri Akhil Arora, The Chairman (Ex-Officio), Rajasthan Drugs And Pharmaceutical Ltd. (A Govt. Of India, Undertaking) Presently Principal Health Secretary, Govt. Of Rajasthan, Secretariat, Tilak Marg, C-Scheme, Jaipur (Raj.). ----Respondents For Petitioner(s) : Mr. Manish Sharma, Mr. P.K. Sharma For Respondent(s) : Mr. Rajesh Kumar for Mr. Indresh Sharma HON'BLE MR. JUSTICE SUDESH BANSAL HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 19/02/2026 1. By means of filing instant contempt petition, petitioner raised an issue of disobedience of the final order dated 02.03.2021 passed in D.B. Special Appeal (Writ) No.253/2019, whereunder the writ petition filed by petitioner was allowed, entitling the [2026:RJ-JP:7989-DB] (2 of 3) [CCP-378/2022] petitioner to get perks and allowances based on the revised pay- scale w.e.f. 26.11.2008. 2. It appears that the final order dated 02.03.2021 was challenged by respondents before the Hon’ble Supreme Court by way of filing Special Leave to Appeal (Civil) No.9478/2023, and the special appeal was dismissed on 06.01.2025, directing respondents (petitioner therein) to ensure compliance of the directions issued by the Division Bench of the High Court within a period of six weeks. 3. In compliance thereof, respondents, after due calculation of the perks and allowances payable to petitioner based on the revised pay-scale w.e.f. 26.11.2008, have made payment of Rs.3,01,406/- through a bank draft of Bank of Baroda dated 18.02.2025, drawn in favour of the petitioner, along with a computerized computation sheet. 4. Counsel for petitioner, during course of arguments, states that computation of amount of Rs.3,01,406/- is erroneous, and indeed the said amount has been underpaid. However, no fresh calculation or material, contrary to the computerized computation furnished by the respondents, has been placed on record. 5. We are surprised that without questioning the computation made by the respondents, petitioner got revived this contempt petition. Be that as it may, in contempt petition, no fresh adjudication can be undertaken, more so when no detailed computation or supporting material, has been furnished on behalf of the petitioner. [2026:RJ-JP:7989-DB] (3 of 3) [CCP-378/2022] 6. We are of the considered opinion that since respondents have paid amount of Rs.3,01,406/-, which has also been received by the petitioner, the issue of disobedience of the order dated 02.03.2021 does not survive. 7. Accordingly, the proceedings of instant contempt petition are closed and the contempt petition is hereby dismissed. Notices of contempt stand discharged accordingly. 8. Pending application(s), if any, stand(s) disposed of. (ANIL KUMAR UPMAN),J (SUDESH BANSAL),J Sachin Sharma/6
