This criminal appeal has been preferred by the appellant aggrieved by the order dated 14.10.2025 passed by the Court of Special Judge SC/ST (Prevention of Atrocities) Cases, Alwar, in 5th Bail Application No. 375/2025 (CIS No.370/2025) in connection with F.I.R. No.118/2023, registered with the Police Station Arawali Vihar, Alwar, for the offence under Sections 302, 392 of IPC and Section 3(2)(V) of SC/ST Act, whereby, 5th bail application filed by the applicant-appellant under Section 437/439 Cr.P.C. was rejected. [2026:RJ-JP:9895] (2 of 3) [CRLAS-2969/2025] 2. Heard. 3. Considered the submissions made at the Bar and perused the material on record. 4. Earlier, the appeal bearing S.B. Criminal Appeal (sb) No.362/2024 filed by the accused-appellant, was dismissed vide order dated 08.08.2024 and the subsequent appeal bearing No.1178/2025 was also dismissed on 05.08.2025. 5. Since this appeal arises from the orders passed by the Courts below on the bail applications filed by the accused- appellant, the Court has to see whether after dismissal of the earlier appeals, is there any material change of circumstances. 6. The learned counsel for the accused-appellant is not able to point out any material change of circumstances since after dismissal of the earlier appeal vide order dated 05.08.2025. He has only submitted that the accused-appellant is in custody since 27.02.2023 and, looking to the long incarceration, he may be ordered to be released on bail. 7. As per the prosecution, there are in all twenty-seven witnesses, out of which twenty-one witnesses have been examined and also one of the witness has been examined in chief, meaning thereby, now only five witnesses remain to be examined. 8. Looking to the nature of the allegations levelled against the accused-appellant, which are serious and grave, this Court at the stage of fag end of the trial of the case is not inclined to enlarge the accused-appellant on bail.
