Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings in E10/1/11035843/ADK/5 dated 10.10.2025 and the consequential proceedings in E09/10933655/4/R0933655/3969 dated 08.01.2026 issued by the 6th respondent, quash the same as being arbitrary, illegal and consequently direct the respondents to approve the selection grade scale of pay of Rs.15600 – 39100 + GP Rs.5400/- in the post of Vocational Instructor with notional fixation from 01.01.2006 and monetary benefits from 01.04.2013 in accordance with G.O.Ms.No.306, Finance (CMPC) Department dated 12.09.2018 and the binding judicial precedents, and further direct the respondents to refix the last drawn pay, pension and pensionary benefits of the petitioner and disburse all consequential arrears and to continue payment of pension based on the last drawn pay already fixed without any alteration. Heard Mr.A.L.Kannan, learned counsel for the petitioner, Mr.M.Dinesh Hari Sudarsan, learned counsel for Government of Tamil Nadu (Civil Side) for respondents 1 to 5, and Mr.P.Gunasekaran, learned counsel for the 6th respondent. 3. Through the impugned proceedings, the pay and pension of the petitioner were revised by duly reducing the grade pay from Rs.5,400/- to Rs.4,800/-, purportedly in the light of various Government Orders issued from time to time. Aggrieved by the said proceedings dated 10.10.2025 and the consequential proceedings dated 08.01.2026, the petitioner has approached this Court by filing the present writ petition. 4. This Court has taken note of the fact that the impugned proceedings were issued without affording an opportunity to the petitioner. Accordingly, by order dated 01.06.2026, this Court granted an interim stay of recovery and the same is operating as on date. 4/8 https://www.mhc.tn.gov.in/judis W.P.(MD)No.14404 of 2026 5. Today, when the matter was taken up for consideration, Mr.P.Gunasekaran, learned counsel appearing for the 6th respondent, and Mr.M.Dinesh Hari Sudarsan, learned counsel for Government of Tamil Nadu (Civil Side) appearing for respondents 1 to 5, brought to the notice of this Court that the Government has acceded to the request for the grant of Grade Pay of Rs.5,400/- to B.T. Assistants like the petitioner herein. Therefore, the impugned proceedings revising the Grade Pay from Rs.5,400/- to Rs.4,800/- cannot stand any longer. 6. Taking into consideration the fact that the Government itself, vide Letter No.E-13347154/CMPC/2026 dated 09.06.2026, has decided to extend the benefit of Grade Pay of Rs.5,400/- to the B.T. Assistants instead of Grade Pay of Rs.4,800/-, the impugned proceedings are liable to be quashed. Accordingly, the impugned proceedings are quashed, and the respondents are directed to restore the Grade Pay of Rs.5,400/- to the petitioner herein and to release all consequential benefits to the petitioner as expeditiously as possible, at any rate within a period of eight (8) weeks from the date of receipt of a copy of this order. 5/8 https://www.mhc.tn.gov.in/judis W.P.(MD)No.14404 of 2026 7. In the result, this Writ Petition is disposed of. No costs.
