This writ petition has been filed under Article 227 of the Constitution of India, whereby the petitioner has sought a direction to learned Ist Additional Civil Judge (S.D.) Dehradun to conclude the proceedings of Original Suit No.616 of 2021, Smt. Uma Rani vs. Smt. Nikita Sharma, expeditiously in stipulated period without granting unnecessary adjournments to either of the parties. 3. Learned counsel for the petitioner submitted that the petitioner has instituted an O.S. No.616 of 2021 for declaration and permanent injunction; however, the respondent has been consistently adopting dilatory tactics to stall the proceedings through repeated, unjustified adjournments and unauthorized absences between August 2023 and March 2025, thereby frustrating the spirit of Order 17 Rule 1 (1) of the CPC. He further emphasizes that such conduct amounts to a mockery of the judicial process and demonstrates a clear lack of intent for an early disposal, necessitating the intervention of this Hon’ble Court to implement a time-bound arrangement for the suit as mandated by the Hon'ble Apex Court in the case of Ram Rameshwari Devi v. Nirmala Devi reported in (2011) 8 SCC 249 to ensure the expeditious administration of justice. 4. From perusal of the record, it is apparent that even the issues have not been framed in Original Suit No.616 of 2021, Uma Rani Vs. Nikita Sharma, therefore, at this stage this Court cannot issue a direction for expeditious disposal 2 of the said suit. 5. Accordingly writ petition stands dismissed.
