Heard Mr.T.Sakthi Kumaran, learned counsel for the petitioner and Mrs.K.Porkodi, learned counsel for the Government of Tamil Nadu, who takes notice for the first respondent and Mr.M.Thirunavukkarasu, learned counsel, who takes notice for the respondents 2 & 3. 3. Though a lengthy affidavit has been filed in support of this writ petition narrating the entire service particulars of the petitioner and previous rounds of litigation initiated by him before this Court, the only ground argued before this Court is that the impugned transfer order has been issued transferring the petitioner from the third respondent – Union to the fourth respondent – Union, though several other seniors to the petitioner are available in the third respondent – Union. ____________ https://www.mhc.tn.gov.in/judis W.P.(MD) No.18071 of 2026 4. Transfer is an incident of service. Unless and until the same adversely affects the pecuniary or other service benefits of the employee or the transfer order is tainted with mala fides or issued for extraneous considerations etc., normally this Court will not interfere with the orders of transfer as the same will be effected due to exigencies of service on administrative grounds. Merely because there are several seniors available to the petitioner in the third respondent – Union, that does not create an embargo on the competency of the authority concerned to transfer the junior- most employee from one Union to another Union. Competency of the third respondent herein is not under dispute. In the absence of any dispute about the competency of the third respondent to issue the impugned transfer order, this Court does not find any force in the only contention raised by the petitioner to attack the impugned transfer order. 5. Further, from the perusal of the affidavit filed in support of this writ petition, it is evident that huge amounts are being recovered from the petitioner from the month of June, 2025, on the ground that he is liable to remit a sum of Rs.6,07,287.50 to the respondents and the same is admittedly not contested by the petitioner as on date. ____________ https://www.mhc.tn.gov.in/judis W.P.(MD) No.18071 of 2026 6. In the light of the above, this Court does not see any reason to interfere with the impugned transfer order. Accordingly, this writ petition is dismissed. No costs.
