-And- In the matter of : NURSENA BIB @ NURSENA KHATUN … … Petitioner Mr. Sagar Saha Mr. Manjeet Saha, Mr. S. Das, Advocates … … For the Petitioner Mr. Goutam Dey, Ms. Moumita Pandit, Advocates … …For the State
1. Petitioner seeks anticipatory bail in respect of a double murder. Materials in the case diary throw up an element of doubt as to the involvement of the petitioner. There is a discrepancy between the name appearing in the first information report and the statement recorded under Section 180 of the BNSS, 2023.
2. Purely on the ground of benefit of doubt and considering the fact that police filed charge sheet and considering the fact that the petitioner before Court is a lady, I grant anticipatory bail to the petitioner.
3. Accordingly, I direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of
2 Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
