Heard Mr. A. Das, learned counsel for the petitioner. Office note dated 21.04.2026, indicates that neither A/D card nor unserved notice in respect of the respondent Nos. 1 to 10 has been returned till date. Mr. Das submits that the next date of the case is fixed before the learned trial Court on 16.05.2026. He has also pointed out that vide impugned order dated 22.08.2025, the learned trial Court has dismissed the application filed by the petitioner under Order 1 Rule 10, read with Section 151 of the CPC, on the ground that the application was not supported by any document. Mr. Das further submits that instead of keeping the matter pending, it may be disposed of by giving liberty to the petitioner to approach the learned trial Court again by filing a fresh petition under Order 1 Rule 10 CPC with relevant documents. The submission of Mr. Das has received due consideration of this Court. Also, this Court has carefully gone through the record, especially the impugned
order dated 22.08.2025. Accordingly, taking note of the submission of Mr. Das, learned counsel for the petitioner, this Court is inclined to dispose of this petition by granting liberty to the petitioner to approach the learned trial Court again by filing appropriation petition under Order 1 Rule 10, read with Section 151 of the CPC, along with supporting documents. And on such petition being filed, the learned trial Court
Page No.# 4/4 shall consider the same in accordance with law. To the extent as indicated above, the impugned order dated 22.08.2025, stands interfered with. In terms of above, this revision petition stands disposed of. JUDGE Comparing Assistant
