2. The petitioner has filed this petition praying for following relief:-
“It is therefore prayed accordingly that on the above facts and circumstances this instant petition be allowed and quash the charge sheet/final report dated 26.05.2023, having its Final Report no. 167/2023, of Police Station:- Bemetara, District :- Bemetara, and also to quash the proceedings pending before Judicial Magistrate First Class, Bemetara, District :- Bemetara (C.G.) in criminal case no. 699/2023 (State of Chhattisgarh vs. Jitendra Solanki), in the interest of justice.”
3. From perusal of the relief clause, it transpires that though copy of
order framing charge has been annexed with the petition, but the same has not been challenged. This shows that the counsel for the petitioner has drafted a vague and sketchy prayer in a casual manner, thereby wasting the precious time of the Court.
4. In view of the same, learned counsel for the petitioner pray to withdraw the present petition with liberty to file afresh.
5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs. 5,000/- as cost by the petitioner in the Registry of this Court and the same shall be transmitted to the Government Multi Handicapped Special School, Bagbahra, District- Mahasamund (C.G.), for wasting the precious time of this Court.
