06.10.2026 Sl.No. 14 Ct. 39 Amalranjan IN THE HIGH COURT AT CALCUTTA CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE
CRR/4211/2026 OM SAREE HOUSE PRIVATE LIMITED VS STATE OF WEST BENGAL
Mr. Dipanjan Dutt Mr. Soumadip Ghosh …for the petitioner
1. The petitioner filed this revisional application seeking a direction for expeditious disposal of the proceedings being Case no. CN 468 of 2019, under Section 138 of the Negotiable Instruments Act, 1881 pending before the learned Judicial Magistrate, 14th Court, Calcutta.
2. It is submitted by learned counsel appearing on behalf of the petitioner that on two earlier occasions, the co- ordinate Bench of this court directed the Trial Court to expedite the trial and conclude the same in two different revisional applications being CRR No.2363 of 2022 and CRR No.1461 of 2025 filed by the Petitioner vide orders dated 14th September, 2022 and 03.04.2025 respectively. The Trial Court, however, neither concluded the trial nor disposed of the matter on merits. The case has been pending since 2019; as such, a time-bound direction may be passed so that the matter can be
2
disposed of and the petitioner can get justice from the court of law.
3. The prayer for expeditious disposal is very simple and innocuous. There is no impediment to passing such
order, as the complaint filed under Section 138 of the N.I. Act, shall be disposed of by conducting a summary trial, which should proceed on a day-to-day basis with a target to conclude the same within 6 months from the date of filing the complaint in view of the provision as laid down under Section 143 of the N.I. Act, 1881. Admittedly, the complaint filed under Section 138 of the N.I. Act has been pending since 2019. Even after the lapse of 7 years and despite earlier directions passed by the Co-ordinate Bench of this court, the trial court has failed to conclude the trial.
4. Accordingly, the Trial Court is once again directed to dispose of the case as expeditiously as possible without granting unnecessary adjournment to either of the parties and take it to its logical conclusion independently in accordance with law. This court hopes and trusts that the Trial Court will expedite the trial and dispose of the same. If the accused fails to appear before the court on the date fixed, the Trial Court shall exhaust all necessary process.
5. Accordingly, CRR 4211 of 2026 stands disposed of.
6. Consequently, the connected application, if any, stands
disposed of.

7. Interim order, if any, stands vacated.
8. Let a copy of this order be communicated to the learned court below forthwith.
9. All parties shall act in terms of the copy of this order downloaded from the official website of this court.
10. Concerned Department is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
