WP No. 15020 of 2026 This writ petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the 1st to 5th respondents for conducting a departmental inquiry against 6th respondent and cancel the compassionate appointment, she received through fraud by preparing fake documents required departmental action on petitioner representation dated 20.02.2026 within stipulated period in accordance with law. For Petitioner(s): Mr. P.Veeraraghavan For Respondent(s): Mr. T.Chandrasekaran, SGP, for R1 to R4 Mr.A.M.Ayyadurai, G.A., for R5 ORDER This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 1 to 5 to conduct a departmental enquiry against the 6th respondent and cancel her compassionate appointment. 2. The case of the petitioner is that her father E.Swaminathan, who was working as Union Supervisor in Sembanar Koil Panchayat Union, Mayiladuthurai District, died on 10.06.2021 leaving behind his wife, his mother, the petitioner, and the 6th respondent. According to the petitioner, the 6th respondent forged her signature, prepared fake documents and obtained compassionate appointment. Therefore, the petitioner submitted a representation to the respondents 1 to 5 seeking departmental enquiry against the 6th __________ Page2 of 5 https://www.mhc.tn.gov.in/judis
WP No. 15020 of 2026 respondent and cancellation of the appointment, but no action was taken. Hence, the present writ petition was filed. 3. After hearing both sides and examining the records, this Court found that the 6th respondent had already been appointed through proceedings dated
28.07.2023. The record also shows that the petitioner had earlier sent a letter dated 24.11.2022 to the third respondent, indicating that she was aware of her sister’s application for compassionate appointment. However, the petitioner neither approached the Court at that time nor challenged the appointment after it was granted. Further, she had not even made any application for compassionate appointment for herself.
