CRL.OP.(MD)No.12833 of 2026 ORDER Present criminal original petition has been filed by the sole accused in C.C.No.819 of 2025 on the file of the Judicial Magistrate, Periyakulam, Theni District seeking to quash the charge sheet wherein the petitioner is charged under Sections 171(F) IPC r/w Section 179 of the Motor Vehicles Act. 2.According to the learned counsel for the petitioner, the date of occurrence is 24.03.2024, and the FIR was registered on the very same day. However, the charge sheet came to be laid only on 10.12.2025. He further submitted that the punishment prescribed for the offence under Section 171(F) IPC is imprisonment for one year, and the punishment prescribed for the offence under Section 179 of the Motor Vehicles Act is a fine of Rs.200/-. Therefore, according to him, in view of Section 468(2)(b) Cr.P.C., the charge sheet ought to have been laid within a period of one year. Since the charge sheet was laid only on 10.12.2025, it is clearly barred by limitation. 3.The learned Government Advocate(Crl.side) appearing for the first respondent submitted that the charge sheet was laid on 10.12.2025. 2/5 https://www.mhc.tn.gov.in/judis
CRL.OP.(MD)No.12833 of 2026 4.Heard the learned counsel on either side and perused the available records. 5.The dates and events mentioned above are not in dispute. The charge sheet has not been laid within the period prescribed under Section 468(2)(b) Cr.P.C. In such circumstances, the continuation of the criminal proceedings against the petitioner would amount to an abuse of the process of law. Accordingly, the charge sheet in C.C.No.819 of 2025 on the file of the learned Judicial Magistrate, Periyakulam, Theni District, stands quashed. 6.In the result, this criminal original petition is allowed. Consequently, connected miscellaneous petitions are closed.
