1. Affidavit-of-service filed on behalf of petitioners is taken on record. 2. Two petitioners are before this Court seeking direction upon concerned police authority to take steps which would enable them and their family members to return back to their respective residence and stay there without any hindrance. 3. A case is made out in the writ petition that concerning access to one water body, as petitioners were engaged in pisciculture, in November, 2023 they were driven out of their residence which compelled them to stay elsewhere. Complaints were lodged before the concerned police authority which gave rise to Sagarpara Police Station Case No.355 of 2023 dated 22nd November, 2023. 4. Learned advocate representing State respondents has filed a communication dated 27th September, 2026 of Officer-in-Charge,
Sagarpara
Police
Station, Murshidabad and same is taken on record. Copy of the said communication is made over to learned advocate representing petitioners. [2]
5. It is disclosed in the said communication that on concluding investigation in Sagarpara Police Station Case No.355 of 2023 dated 22nd November, 2023 charge-sheet dated 31st January, 2024 was filed before the jurisdictional Magistrate. 6. In view of filing of charge-sheet dated 31st January, 2024 by the concerned police authority on concluding investigation in aforesaid criminal prosecution, no further order need be passed in this writ petition thereby directing the concerned police authority to conclude the investigation or to take steps in connection therewith. 7. However, it is stated in the writ petition that petitioners are compelled to stay elsewhere from November, 2023 due to threat and intimidation. 8. Petitioners shall be at liberty to make a fresh representation to the Officer-in-Charge, Sagarpara Police Station being respondent no.8 by three (3) weeks from date seeking police assistance and protection which would enable them to return back to their own residence and lead normal life.
If such representation is made by petitioners, in that event, respondent no.8 shall take necessary steps so that petitioners can return back to their residence and stay there without any intimidation and threat along with members of their family. 9. With the above directions writ petition stands disposed of. 10. Parties to act on the server copy of this order duly downloaded from the official website of this court. (SAUGATA BHATTACHARYYA, J.)
