Petitioners claimed to be employees of U.P. Provincial Cooperative Federation, except petitioner Nos. 13, 14 and 15, who are legal representatives of employees of U.P. Cooperative Federation. 3. According to petitioners, they are entitled to certain benefits which have not been paid to them. 4. By means of this writ petition, petitioners have sought the following reliefs: “i. To issue a writ, order or direction in the nature of mandamus, directing the respondents, especially respondent no.1 and respondent no.3 to grant to petitioners the benefits of Time Bound Promotions /ACP, Earned leaves, Bonus, Contribution and other increments, and escalation in Dearness Allowance (D.A.), which occurred after 01.01.2005, as has been paid to similarly situated other employees of UCF, who opted for State of Uttaranchal and were not litigants before High Court of Allahabad, Lucknow Bench, and accordingly the difference of the amount of Gratuity and Provident Fund be paid to the petitioners. ii. To award interest @ 18% per annum on the aforesaid amount from the date it became due. iii. To issue a writ, order or direction in the nature of mandamus, directing respondent no.1 to refund to the 2026:UHC:31 petitioners, the Security amount deposited by each employee at the time of joining before the PCF UP, which was refundable at the time of retirement, along with the interest accrued on the deposited amount, and which has been transferred by PCF UP along with interest accrued till then, to the UCF, after the bifurcation of the State of Uttar Pradesh and settlement arrived at between the two States (i.e State of Uttar Pradesh and newly constituted State of Uttaranchal now Uttarakhand).” 5. Learned counsel for the petitioners submits that petitioners have made representation to Managing Director, Uttarakhand Cooperative Federation, therefore he may be directed to take decision thereupon. 6. Mr. Lalit Samant, Advocate appearing for Uttarakhand Cooperative Federation submits that decision, if already not taken, shall be taken within eight weeks. 7. The writ petition is, accordingly, disposed of with a direction to Managing Director, Uttarakhand Cooperative Federation to take decision on representation dated 23.12.2025, as per law, within eight weeks from date of presentation of certified copy of this order.
