23 0066..1100..22002266 Ct. No. 05 adeb WPA 26271 of 2026 Subal Mridha Vs. The State of West Bengal & Ors. Mr. Nirmalendu Bera Mr. Gorachand Samanta Ms. Tanima Nandy …for the petitioner Mr. Pradip Paul Mr. Amit Dey …for the State Mr. D. Banerjee Mr. Sk. Samiul Hque Mr. Mohiul Islam …for the respondent no. 4 1. Affidavit of service filed on behalf of petitioner is taken on record. 2. Petitioner prays for direction upon the concerned police authorities to take steps which would permit the petitioner to enjoy possession over the land in question. It is also submitted that in a pending suit Civil Court passed an order of status quo. 3. State respondents and respondent no. 4 are represented by learned advocates. 4. It is jointly submitted on behalf of State respondents and respondent no. 4 that issue involved in this writ petition is civil in nature requiring petitioner to approach appropriate forum. If status quo order is passed by Civil 2 Court in pending suit concerning land in connection with which present writ petition is filed in that event this is not an appropriate stage to direct concerned police authorities to take steps based on such order passed by Civil court. Petitioner has alternative remedy by approaching Civil Court under Section 151 CPC. Since at the interim stage no right is crystallized in favour of petitioner in connection with land in question no direction is warranted by this Court on entertaining this writ petition. 5. Writ petition stands dismissed. 6. However, this order shall not preclude the petitioner to approach appropriate forum in pursuit of remedy. 7. Parties to act on server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
