Mr. Abhishek Verma, Advocate for the petitioner. Mr. Narain Dutt, Standing Counsel for the State of Uttarakhand. Mr. Shailendra Nauriyal, Advocate for respondent no.3. 2. An advertisement was issued by respondent no.3 on 13.10.2023, inviting applications for the post of Village Development Officer. As per the said advertisement, five posts were reserved for Physically Handicapped candidates. The petitioner, being eligible under the said category, submitted his application pursuant to the same. The petitioner was declared successful in the written examination. Thereafter, a provisional merit list dated 14.07.2025 was published, calling upon the qualified candidates to appear for document verification on 21.07.2025. 3. The specific case of the petitioner is that he is a permanent resident of Village Pasia, Post Office Deoli, Tehsil Dhari, Block Okhalkanda, District Nainital, which is a remote and hilly area of Uttarakhand having poor network and communication facilities. Consequently, he could not obtain timely information regarding the schedule of document verification. Subsequently, respondent no.3, vide communication dated 27.08.2025, rejected the candidature of the petitioner along with three other candidates belonging to the Physically
2026:UHC:405 Handicapped category, on the ground that they had failed to appear before the Commission for document verification on
21.07.2025. Upon receiving intimation of such rejection, the petitioner promptly submitted a representation before the competent authority. When no decision was taken thereon, the petitioner filed Writ Petition (S/ S) No. 1523 of 2025, which was disposed of by Coordinate Bench of this Court vide order dated 16.09.2025, directing respondent no.3 to consider and decide the petitioner’s representation in accordance with law. Pursuant thereto, the said representation came to be rejected vide order dated
08.12.2025. 4. On last occasion, learned counsel for respondent no.3 was directed to get instructions in the matter. Today, he has informed the Court that though the typing test of the selected candidates has been conducted, but the final result has not yet been declared. 5.
In view of the fact that the rejection of candidature of the petitioner and three other similarly situated candidates was solely on account of their non- appearance for document verification, coupled with the admitted circumstance that the petitioner hails from a remote region with limited communication facilities, and having further regard to the fact that the posts in question are reserved for Physically Handicapped candidates and the final result has not yet been declared, the respondent no.3 is directed to issue a corrigendum. The said corrigendum shall afford one additional opportunity to the petitioner and the other three candidates belonging to the Physically Handicapped category,
2026:UHC:405 who were declared successful in the written examination but whose candidatures were rejected for non- appearance in document verification, to appear for such verification, and thereafter be permitted to undergo the typing test, as may be applicable to them. 6.
