Declare and set aside the Order dated 01.10.2012 passed by the Division Bench in W.P. No. 24506 of 2012 as being Coram non judice and passed in flagrant disregard of settled principles of law; Consequentially, declare and set aside the subsequent orders dated 02.11.2012 and 25.06.2015 passed by Respondent No.1 in O.A. No. 962 of 2011 on the grounds that the same are founded upon the Coram non judice order dated 01.10.2012; b. Exercise the power of superintendence vested in this Court under Article 227 of the Constitution of India for ensuring that the subordinate Respondent No. 1 functions strictly within its legal parameters and jurisdiction and to allow the C.A No.49 of 2012 and M.A No. 221 of 2012 in the OA No.962 of 2011. The present Petition has been numbered and listed for admission subject to maintainability. 2.The facts in brief would show that the petitioner served in Films Division in the Department of Information and Broadcasting. He was placed https://www.mhc.tn.gov.in/judis CRP No. 3804 of 2026 __________ Page3 of 6 under suspension on initiation of departmental disciplinary proceedings. The petitioner approached the Central Administrative Tribunal and the order of suspension was set aside along with the direction to reinstate him. However, a review application was filed by the department, which was dismissed and the petitioner filed a Contempt Petition against the order of the Tribunal. The department filed a writ petition before the High Court and the order of the Central Administrative Tribunal was modified. The writ order became final. Based on the writ order, the contempt petition filed before the Central Administrative Tribunal was closed. Subsequently, the departmental disciplinary proceedings was concluded and the punishment of compulsory retirement was imposed even before his actual date of superannuation. 3.In this context, the present Civil Revision Petition has been instituted with the following relief: “a. Declare and set aside the Order dated 01.10.2012 passed by the Division Bench in W.P. No. 24506 of 2012 as being Coram non judice and passed in flagrant disregard of settled principles of law; Consequentially, declare and set aside the subsequent orders dated 02.11.2012 and 25.06.2015 passed by Respondent No.1 in O.A. No. 962 of 2011 on the grounds that the same are founded upon the Coram non judice order dated 01.10.2012; b. The petitioner is raising dispute relating to his service in the government department and therefore the relief now sought for by filing a Civil Revision Petition under Article 227 of the Constitution of India is not entertainable. However, liberty is granted to the petitioner to work out his remedy and to redress his grievances relating to his services in the manner known to law. 4.With these observations, the Civil Revision Petition stands dismissed as not maintainable.
